The Service may not be used to send bulk email. Bulk email is defined as 'email sent to two or more recipients with substantively identical content'.

NOTE: Forwarding a joke/proposal/invitation, etc., to multiple associates/friends/relatives is not considered a violation of this agreement if the recipient would reasonably expect to receive such email from You.

Using the Service SMTP servers to operate any kind of mailing list or subscription based mailing is prohibited.

Using the Service SMTP servers to send email from automatic services, or programs, or scripts, is prohibited. Send this type of email from the computer that generated the message.

Using the Service as a drop box to receive responses to unsolicited messages sent via email through another service provider or other mechanisms, including, but not limited to, Usenet postings, forum postings, and FFA (free for all) link sites.

Using a trial account on the Service to immediately acquire a Paypal account or make online purchases is suspect behavior and is expressly prohibited.

Forging headers in an attempt to disguise the true origin of the email. Forging headers is illegal in many states and may result in legal action.

Any activity that facilitates the sending or receiving of unsolicited bulk email.

Activities that are illegal or unlawful.

Harassment.

The Service may not be resold without authorization.

Automated access of the Account Manager or the webmail clients.

Using the SMTP servers to send challenge email from Challenge/Response products running on the desktop.

The Service may be terminated for any reason, in whole or in part, effective immediately, by Us at any time without notice and without any liability whatsoever, and You hereby release Us from any such liability. We are not liable to You or any third party for termination.

Upon Service termination, Your right to use the Service immediately ceases and We are not obligated to forward any unread or unsent messages to You or any third party.

If the Service is terminated for any reason other than violation of this Agreement, you will receive reimbursement of the pro-rata portion of the amount paid for the period remaining on Your account for the terminated Service.

No reimbursement or credit will be issued if the Service is terminated due to Your violation of the terms of this Agreement.

We will not disclose Your personal information to third parties unless you have authorized Us to do so except in certain limited circumstances:

We do not visually examine the contents of Your email unless we have to do so in order to resolve technical problems.

We may use software to inspect Your email for spam filter tuning purposes whether or not You have spam filtering enabled.

We may visually inspect email deposited in Your Junkmail or Discard folder for spam filter tuning purposes.

We routinely visually inspect email headers for spam blocking and spam filter tuning purposes.

We make no warranties of any kind, whether express or implied, for the services to be provided hereunder. You agree that Tuffmail shall not be liable for any losses or damages of any kind to You, including, but not limited to, those that may result from service interruptions, delays, non-deliveries, mis-deliveries, or viruses. Additionally, Tuffmail makes no warranties regarding its ability to recover any lost file, regardless of how or why the file was lost.

You agree to hold Us harmless from any lawsuits, claims, damages, liabilities, or expenses arising out of Your actions or the actions of any person using the Your account. This indemnification provision shall survive any termination of Your account.

We reserve the right to modify the Service as described in the Agreement and on the web site, and to change the terms and conditions of this Agreement at any time, without notice. Continued use of the Service after such modifications shall be deemed as Your acceptance to be bound by the terms of the modified Agreement.
